This Privacy Policy explains how Nexus Agent LLC ("Nexus Agent," "we," "us," or "our") collects, uses, shares, and protects information when you visit this Site or purchase a product from us.
1. Who We Are
This Site is operated by Nexus Agent LLC, a limited liability company registered in the State of Colorado, USA, with a registered address at 6674 S Penrose Ct, Centennial, CO 80121. For any privacy questions or requests, contact us at support@nexusagentapi.com.
2. Information We Collect
We collect the following categories of information:
- Contact and order information: name, email address, billing address, order details.
- Transaction information: products purchased, price paid, order date, download activity. We never see or store your full card number or payment account login credentials.
- Account information: username and encrypted password, if you create an account.
- Communications: messages you send us via the contact form or email, and any product reviews you submit.
- Technical and usage information: IP address, browser type, device information, pages visited, and referring URLs, collected automatically via cookies and server logs.
3. How We Collect Information
We collect information in three ways: (1) directly from you, when you create an account, place an order, submit a review, or contact us; (2) automatically, through cookies and similar technologies as you browse the Site; and (3) from third parties, primarily our payment processor (which confirms that a payment was successfully completed) and our e-commerce platform provider, Shopify.
4. How We Use Your Information
We use the information we collect to:
- Process and fulfill your orders, including delivering digital download links to your email address;
- Communicate with you about your order, account, or support requests;
- Detect, investigate, and prevent fraud, unauthorized transactions, and other illegal or prohibited activity;
- Maintain, secure, and improve the Site and our products;
- Comply with our legal and accounting obligations (for example, maintaining tax and sales records);
- Send you service-related communications; we do not send marketing emails unless you separately opt in, and you may unsubscribe from any such communications at any time.
5. Cookies and Similar Technologies
We use cookies to keep items in your cart between visits and to keep you logged in if you create an account. These cookies do not track you across other, unrelated websites. You can control or delete cookies through your browser settings; disabling cookies may affect some features of the Site, such as the shopping cart.
6. Payment Processing
All payments are handled by our third-party payment processor, Shopify Payments (or another payment method you select at checkout). When you check out, you are also subject to that processor's own privacy policy. We do not store, and never have access to, your full payment card number or payment account login credentials.
7. How We Share Information
We do not sell your personal information, and we never have. We share information only where necessary to operate our business:
- Payment processors (e.g., Shopify Payments), to process your payment;
- Hosting and infrastructure providers (e.g., Shopify), which host the Site and process data on our behalf under their own security practices;
- Professional advisors (e.g., accountants, attorneys), where necessary for our legitimate business operations;
- Law enforcement or regulators, where required to comply with a legal obligation, protect our rights, or prevent fraud or harm.
Any third party we share information with is only permitted to use it to provide the relevant service to us and is not permitted to use it for their own independent marketing purposes.
8. Order and Download Records
We keep order records, including download timestamps and access logs, for as long as needed for accounting, tax, and fraud-prevention purposes, including verifying delivery in the event of a payment dispute, as described in our Terms of Service.
9. Data Retention
We retain personal information for as long as necessary to fulfill the purposes described in this Policy, including satisfying any legal, accounting, or reporting requirements. Order and transaction records are typically retained for several years to comply with tax and accounting obligations, even if you later request deletion of other account data.
10. Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect your information from unauthorized access, disclosure, alteration, or destruction, including encrypted connections (HTTPS) and access controls on our systems. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.
11. International Users
Our Site is hosted and operated from the United States. If you access the Site from outside the United States, your information will be transferred to, stored, and processed in the United States, where privacy laws may differ from those in your country. By using the Site, you consent to this transfer.
12. Your Privacy Rights
Depending on where you live, you may have rights to access, correct, delete, or receive a copy of the personal information we hold about you, or to object to or restrict certain processing. To exercise any of these rights, email support@nexusagentapi.com. We will respond within a reasonable time and may need to verify your identity before fulfilling a request. Note that we may need to retain certain order records even after a deletion request, where required for tax, accounting, or fraud-prevention purposes.
13. California Privacy Rights
If you are a California resident, the California Consumer Privacy Act (CCPA), as amended, may give you additional rights, including the right to know what personal information we collect, the right to request deletion, and the right to opt out of the "sale" or "sharing" of personal information. We do not sell or share personal information as those terms are defined under the CCPA, and we do not discriminate against you for exercising any of your privacy rights. To make a request, email support@nexusagentapi.com.
14. Children's Privacy
The Site is not directed to children under 18, and we do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us at support@nexusagentapi.com so we can delete it.
15. Do Not Track
Some browsers offer a "Do Not Track" signal. Because there is no common industry standard for how to respond to such signals, our Site does not currently respond differently based on a detected Do Not Track signal.
16. Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be reflected by an updated "Last updated" date at the top of this page. We encourage you to review this page periodically.
